am I right thinking that it is practically impossible to upgrade a Solaris 10 system (ZFS root) without a support contract since
(1) Upgrading with install media doesn't work with a ZFS root pool
(2) Upgrading via LiveUpgrade requires certain patches which are unavailable without support contract?
The latter seems a bit surprising since Oracle does provide the patches required for live-upgrading Sol 11 to 11.1.
Or maybe I'm missing something?

For the second one, all parts for LiveUpgrade are available with Solaris. The patches are there to fix problems and this is highly recommended to install it. The final result depends of the initial system configuration.
Because Solaris 11 is different in term of package structure and this version is a ZFS boot only OS, this is not very comparable.
