Patches/extended support for newly implemented 12.1.0.2 system

Hi all,
I'm currently planning for a new project and there is quite an odd requirement. The newly implemented system has to run on 12.1.0.2 as the software currently not supports a higher version (but will be possible to upgrade later). So 12.1.0.2 is out of standard support for quite a while and in order to receive security patches, etc. someone will need extended support.
So far so good, but here comes the tricky part ... this is going to be a new system with newly bought licenses which will probably be purchased at around July/August. At this time 12.1.0.2 is going to be out of extended support anyway ... but question is, if you are buying new licenses and using an old version which no longer has extended support, are you still allowed to use the patches from extended support?
Never had this odd situation before ;-)
