Here, you are applying the patches on top of the RDBMS Oracle Home.
So, once you have done the following from the MOS Notes:
Prepare to create the 12.1.0 Oracle home
Install the 12.1.0 software
Install Oracle Database 12c Products from the 12c Examples CD (mandatory)
Create nls/data/9idata directory
You should apply the RDBMS Patches. This has nothing to do with your existing 11g DB.
You are only applying the bugfixes/updating your Technology Stack Code.
So, it is mandatory that you perform the step as advise by the MOS Notes: 1524398.1

Is it an issue if I apply them post upgrade? I have looked at them and they address issues you get with using 12c .... is there any harm in applying them post upgrade?
I have applied them all without issue. Has anyone had any luck applying these before the actual upgrade?
The additional patches go directly into the 12.1 Oracle Home. You apply these patch after creating the new 12.1 Oracle Home before upgrading the database.
You should apply any EBS Interop patches before upgrading the database.
