New Eloqua emails -- Enable Legacy Rendering or no?

When creating a new email in the Eloqua email editor, it looks like the Enable Legacy Rendering setting is disabled by default. And reading the documentation, it is hard to tell if we are supposed to leave it disabled for new emails, since the first thing the documentation tells us is how to enable it for new emails.

So the default (non-legacy) "newer" doctype is the HTML 4 transitional doctype:

<!DOCTYPE html PUBLIC "-//W3C//DTD XHTML 1.0 Transitional //EN" "http://www.w3.org/TR/xhtml1/DTD/xhtml1-transitional.dtd">

While the doctype with the "Enable Legacy Rendering" setting enabled appears to be the HTML5 doctype:

<!DOCTYPE html xmlns='http://www.w3.org/1999/xhtml'>

It seems odd to me that the "Enable Legacy Rendering" doctype is the HTML5 doctype.

So my question is: should "Enable Legacy Rendering" be enabled for all new emails, and if so, why isn't that the default in the Eloqua email editor?
