How to set Invoice to not require for Lot Number of backordered Item?

I have turned off to allow invoices without fulfilment and show backorders on invoice. I have an order with a standard inventory item that is fulfilled, and a line for a lot numbered item that is on backorder, and when I select the "Bill Next" button, it shows only the one inventory item line on the preview, but on save it is asking for a lot number. How do I set it so it does not look for what is not yet fulfilled?
