Illinois Pay Transparency Requirement

Illinois implemented a pay transparency law effective January 1, 2025. Key requirements include:

  • Pay Disclosure: Job postings must include the salary or salary range, plus a general description of benefits and other compensation (e.g., bonuses, stock options).
  • Good Faith Range: The disclosed range must reflect what the employer reasonably expects to offer. Ranges like "$1 to $1,000,000" do not meet the requirement.
  • Remote Jobs: The law applies to:
    • Roles performed (in whole or part) in Illinois.
    • Roles performed outside Illinois if the employee reports to a supervisor, office, or site located in Illinois.
  • Third-Party Postings: Employers must provide pay and benefit info to third parties posting on their behalf.
