Using Groups with Subgroups - not getting expected Results

We have created a group with sub-groups to gather a population of users to assign to a learning plan. Results returned are more users then expected.Content
We have created a dynamic group with a dynamic subgroup to try to gather a smaller population of users. Here's our example.
Dynamic Group 1 - User with worker type of Employee (13,800 users)
- Item Type 'Users', Operator 'Equals', Field Name "WorkerType" Employee (all workers with a type of Employee)
These two groups are sub groups of the one above
- Dynamic Sub-Group 1 - contains workers not equal to Company 'A' AND workers Not Equal to Company 'B' AND Workers Not in Department 'C' and Workers Not In Department 'D' - this group returns - 10600
