Why does the system allow us to assign a disabled custom alert template?

Hi,

We have created and enabled our own template for the Learning Custom Alert. We have disabled the seeded Sample Template. 

However, when the Learning Admin assigns the Learning Custom Alert to a learner, the system prompts to select either the enabled custom template or the disabled seeded template. Simulate Run is set to No. Why would the system allow us to choose a disabled template? Does anyone else experience this as well? When we select the disabled template, the system says the alert will be sent shortly, but it is actually not sent. The alert history shows that the alert was not sent. Could it be a bug?
