Data management Source Filter results in empty data set and makes process fail

Summary:

Data is empty in the filter defined in Source Filter during the start of the closing week, but works OK later when data is posted to the filter intersection.

Data management rule is called within batch script (Powershell). I would like to know how to pass an exception so that when the Source filter/Rule doesn't find valid data doesn't interrupt the rest of the batch.
