Subscription is triggered even when node filter condition is not met

I have a node condition in place which will check whether FCCS flag is TRUE and only those nodes are included for subscription. Now additionally, it was the ask to make the Variance reporting and Time balanace property as Blank in Master when the FCCS Flag is False. This is working fine for new node additions, however, I have an issue with scenario #3 here.

Why is the subscription request getting generated at all for scenarios 3 even though the property values are incorrect and the validation error makes sense ? what is the way to fix this ?
