Must we buy license on our standby database server ???

 I read a lot of document on licensing but I'm not quite sure of the legacy terms.

We have to install an instance database with a failover site on VM servers with windows 2003.  We will implement Oracle entreprise edition on both with dataguard tools to manage archive log shipping and loading.  Our failover database server will be create and start in standby mode to receive archive log.  Nobody except sysdba could access the failover database server.

Do we need to be fully licensed for our fail over database server even if nobody access to?
