Upgrade from Oracle 11.1.0.6.0 to 11.1.0.7.1

Trying to apply patch 8833297 to overcome bug number 7147411 Memory corruption (which filled over 60GB in short time due to number of core dumps) 

 I get the following error when trying to apply the patch:

Prerequisite check "CheckApplicable" failed.
The details are:
Patch "8833297" is a no-op patch.

However when I run the pre-check I get:

Patch history file: /u01/app/oracle/product/11.1.0/db_1/cfgtoollogs/opatch/opatch_history.txt

Invoking prereq "checkconflictagainstohwithdetail"

Prereq "checkConflictAgainstOHWithDetail" passed.

Anyone know where to go from here, I tried searching the knowledgebase but no luck so far.
