Problem with BI Publisher PDFBOOKBINDER API

I am using PDFBOOKBINDER API to generate books, it works well, the trouble I am having is a PDF compatiblity problem. For example

I can use a PDF generated as 1.4 or even 1.5, but if I use a PBF generated from Acrobat distiller 9.4.5 (Windows) as a producer it crashes PDFBOOKBINDER.

The error message just says "file looks corrupt"

Do I need to upgrade PBFBOOKBINDER, if so how.
