Non Orderable Products available for selection in Configurator session

 Hi - We have a customizable product set up with many relationhips of Domain Type 'Dynamic Class'. It is observed that while in a configurator session, we are able to see and select products belonging to the relationship even though they are marked as non orderable and have a Product Effective To date in the past in the product admin screen. 
The user is able to select the non orderable product and hit 'Done' on the config. session. However, when the Customizable product is expanded on the Line ITem view, we observe that none of the selections made in the configurator sessions are retained.
