DATABASE NOT SHUTTING DOWN BECAUSE OF ACTIVE USERS

We are running oracle 10.2.0.3 64 bit enterprise edition on windows 2008 server

we run a cold backup nightly to copy production datafiles down to development env.

Randomly the cold backup fails with ora-01013 and I have narrowed it down to basically not being able to shutdown because of active users.

Below is excerpt from alert log when it failed to shutdown last night:
