E1 0 check printing is suppressed in UBE but the node created in XML causes the header to print on a

My rtf has a header and body.  The XML file generates the level break sections but there is no data.  The header prints with no data, of course.  the body does not print.  How an I suppress the header if no check data if found?

I have tried several IF not statements related to header but the do not suppress the page, only a line if data. based on a previous post relating to a blank line within a page, but they do not seem to work for a page.
