unable to mount zfs filesystems - permission denied

We are experiencing an issue that we have run into now on 6 or so different servers.  We had thought it was a Live Upgrade issue, but it is now looking like the problem lies in the zfs portion of its lucreate attempts

I have searched the world and MOS and have not found anything close to what we are experiencing, but seeing we have seen it on numerous servers, it cant be an isolated issue.  The core of the issue, is that we are unable to mount ZFS filesystems (other the the rpool)

$ pfexec /usr/sbin/zfs create -o mountpoint=/zfstest rpool/zfstest
