Patch 7461070 fails in EBS 12.0.6 when we upgrade to 12.1.3

Problem Description

We are migrating from environment 12.0.6 to 12.1.3 following note 752619.1 and so far so good. One of the steps in Section 1 requires the application of the AD Minipack patch 7461070. The application of this patch fails and the logs are attached. A whole bunch of ad commands are not created inside $AD_TOP/bin.
Searching Oracle Support, we found the recommendation to apply patch 9474320 to fix these issues. This patch fails with message:

This patch is compatible with: entity 'ad' - codeline 'R12.AD.B'.
Your current on-site codeline for the entity 'ad' is: 'R12.AD.A'.
