PO Terms and Conditions not showing - conterms_exist_flag is null

When printing PO's sometimes the terms and conditions are not displaying. In the rtf template there is an if statement around the T&C that checks if the conterms_exist_flag is N. This flag is NULL when the terms arent' displayed. Does anyone know why this value would be NULL or how it gets set to N.
