agent start with HTTP Listener failed

I could securing the agent 12c with OMS 12c successfully.
Now starting the emctl start agent -> failed with HTTP Listener failed at Startup.
Possible port conflict on port 83872): ... failed to start the agent after 4 attempts.. check the port.

BUT the port is free:
netstat -anp | grep 3872
lsof -i | grep 3872 > returns nothing !!

what / where  would you please suggest to do ?
