ESC: India legislation patch conflict

Hi,
In Dev instance, patch 12730429 (INDIA HRMS CONSOLIDATED UPDATE - R12.IN.07 built: JUL-15-2011) applied on 03-JAN-12.
This is the patch that brought the table structure we were looking for.
On 07-NOV-12, patch 13918344 (12.1 INDIA CONSOLIDATED UPDATE IN.08 built: APR-23-2012) got applied.

The second one brought the perlegin.pdt as it is in the current PER_TOP.
The second one does not have the table structure.

In CERT instance, these 2 patches applied as a merged-patch,
so the latest perlegin.pdt that belongs to patch 13918344 applied.
Merged utility only copies the higher version of a file or script.

so the issue is we need to find out why
