How to stop auto terminating contract sub lines by IB

Hi 
Can some one suggest a solution on the following:

Currently, we have a custom program to create service contracts using APIs for sales orders (SO) that are ship confirmed and interfaced to IB. This program runs once a day to create contracts for SOs that are ship confirmed today.  The product does not have a warranty item added to its BOM, also no warranty line is added to the SO.  Hence, service contracts are NOT auto created.

These contracts are mainly used to bill customer for product rental on monthly basis.

Now the problem is, Assume a product which has an active service contract is received back thru an RMA and the same product is shipped to another customer or same customer on the
