Tax Rule - Freight

Hello,

I am working on creating a rule for our Freight items (they are included in a category and then a product fiscal classification was created).  For this, I created an expert rule entry with a DFS and a CS.  In the condition set however, it will not let me choose a "To Range".  We applied the recommended patch, however this did not do the trick.

With these Freight items, some States collect tax while others do not.  For the States that do not, I need to apply State, county and city rules.  Anyone have any suggestions on how to bypass the condition set difficulty?
