having trouble applying patch 18842982 (May 2015) getting UtilSession device not ready error it look

Windows 2012 server x64

11.2.0.4 Enterprise base install with no databases created yet

trying to apply May 2015 CPU to match production

PATH includes %ORACLE_HOME%\bin;%ORACLE_HOME%\opatch;%ORACLE_HOME%\jdk\jre\bin

upgraded opatch to 11.2.0.3.12

I get a OUI-67073 UtilSession failed. Device not ready error during the NApply phase backing up files.

I have full control on the patch folder and all files and folders under, ORACLE_HOME folder and all files and folder under

I suspect that there is a problem with the UtilSession class where it is trying to set up the backup target and it fails.

Any suggestions on how to debug this?  Do I have the correct java path set up?
