oracle 11.2.0.4 Enterprise on Windows server 2012 64 bit applying May 2015 CPU, getting UtilSession

trying to apply the May 2015 CPU to a brand new install of 11.2.0.4 enterprise on a new Windows 2012 server. All 64 bit

PATH is %ORACLE_HOME%\bin;%ORACLE_HOME%\opatch;%ORACLE_HOME%\jdk\jre\bin

opatch 11.2.0.3.12 replaced the opatch that came with 11.2.0.4

opatch apply fails with error code 73

the log says that UtilSession failed during the NApply backup with a Device not ready error

The Oracle software owner has full control of the ORACLE_HOME folder and all folders and files under it.

The Oracle software owner is a local admin on the server.
