Another opatch apply fail due to code 135

I keep getting error when I use "opatch apply"

staging directory looks good

cd /software/dba/database/patches_12.1.0.2/28980123/28833531/28731800/u01/app/oracle/product/12.1.0/ora12102/OPatch/opatch applyOracle Interim Patch Installer version 12.2.0.1.16Copyright (c) 2019, Oracle Corporation.  All rights reserved.ZOP-51: The patch location is not valid for apply, because it doesn't have correct metadata, or it points to a patch directory.Argument(s) Error... I have a box with

Oracle 12cR1, linux 6.7, nfs storage, single tenant non-rac database

1)

database is shutdown as well as listener
