Employer Exempt for Washington FMLA tax, how to supress?

We upgraded to Vertex 4.2.8 and now we have a Washington Miscellaneous Tax for our WA residents.  Our company is exempt from the employer portion of the tax.  I am wondering how to turn off the tax.    Tax Type 48, H2 - Employer Portion.  I logged a ticket with Oracle; hoping that someone out there has the same issues.
