Inactive and frozen position showing in Fluid Org Chart - why?

We pulled the fix from image 31 so that we can display empty positions within the Fluid Company Org Chart.  The fix works fine, however it is showing empty positions that are inactive.  In short, how does one prevent inactive empty positions from showing?  Am I missing an eff date?  Does the position need to be frozen and inactive?  Do I need to run the HR_TREEBLD process differently?
