The Emergency Family and Medical Leave Expansion Act provides for jobprotected FMLA leave for employees who have been employed for at least 30 days and who have “a qualifying need related to [COVID-19].” The Act modifies the definition of “employer” from those who employ 50 or more to those who employee 500 or fewer.1 “Public agencies”2 are still considered employers without any modification or requirement of a minimum number of employees.
