CEMLI deployment on R12.2.10

When upgrading to R12.2 you deploy CEMLIs after the upgrade and the application of the standard middle tier and RUP patches has happened. How do you know if your custom code will meet the standards of online patching in R12.2? If custom code does not meet the standard does it have to be redeveloped for R12.2?
