COBRA CBR_NONEE - error on PERSONAL_DATA date

I am getting a fatal error when CBR_NONEE tries to write the personal data record on an overage dependent.  The Dependent rule is set to apply date on first of month following.  When CBR_NONEE tries to write the Personal Data record, it uses that date (10-1-2021) which is future.  this causes the component to fail.

this is delivered code, so why doesn't it work right?  Anyone else encounter this problem?
