Fulfillment Release job R4277703 cancels partial fulfilled lines

The Service level rules have been setup to not cancel lines that are partially fulfilled during release. The idea is exclude such lines from getting released. We have setup the data selection to exclude lines that are at status '40', yet these lines get released , the unfulfilled quantity get split into a different line and are cancelled. Is there a setup/configuration that can be done to avoid the issue? The issue occurs in both 9.1 and 9.2.
