rhel8/19c error running /crsctl query has releasepatch from swonly installed grid home

in Database Install/Upgrade/Opatch (MOSC) Question

when trying to validate the sw install of 19.18 grid on rhel 8 we get this error:

NOTE: for out of place patching, we have a configured home (where this command works) and a sw only install for the new/target home where we get the error below. this seems to be ok on rhel7 but gets an error on rhel8

Oracle Clusterware release patch level is [2141693477] and the complete list of patches [33575402 34765931 34768559 34768569 34863894 34932268 ] have been applied on the local node. The release patch string is [19.18.0.0.0].
