SBC Able to Respond to RE-INVITE Message While Waiting On A Response on Previous Request

I believe I know the answer to this, but wanted to get another opinion. We are seeing an issue where a RE-INVITE message is sent out to where the call is being moved from treatment server to a recording server. Instead of a 200 OK message, the sbc received another RE-INVITE message to change the SDP information which fails to establish the call. My question is this, is the sbc able to send a 200 OK message on the new INVITE message from the distance end before receiving a response from the initial INVITE message? I
