FMLA 12 Month Length of Service

Summary

How to derive months length of service for employee over last 7 years even with gaps in employment

Content

US FMLA requires an employee have worked 1250 hours within the last 12 months of employment.  The employee must also have at least 12 months of length of service.  Those length of service months do not have to be continuous.

Our configuration done by the implementation team seems to have set it up so that the length of service is between the hire date of the current assignment and the first fmla absence date.

Scenrio:  Employee 1st assignment was from 11/2/15-5/2016.  2nd assignment was from 10/19/16-Present.  FMLA absence time frame was from 5/18/17-7/14/17.  Those 400 hours of FMLA are not being qualified as eligible since from 10/19/16 to 5/18/17 is less than 1 year(12 months).

Howdy, Stranger!
