Ban the Box regulations - removal of Background Check references from application

We’ve received guidance from our internal Legal department that, in the U.S., there are current Ban the Box regulations and legislation specific to New York City that guides companies to remove any reference to background checks from any application process. This includes online applications.
The issue is that all background screening service providers through Passport are dependent upon the completion of the Background Check Consent block in the application flow. Our Legal team is saying we need to remove this block to comply with the regulations in anticipation of this regulation catching on in other cities and states in the U.S.
