In Talent Profile approvals, the assignment of latest record is not considered for rehire cases

Hi All,
I am facing a weird issue in talent profile approvals. I have written a rule where where if the assignment is for pending worker then it should auto-approve.
Now this is working perfectly fine when a new pending worker record is created:
The problem is coming when a PWK record exists but for a rehire:
Is this how it should work? I was expecting it to take the active pending worker record. E1003228 is not even active.
Please let me know if anyone has any idea/workaround for this.
