Extract Data Chunking task in critical Alerts status when no records

I am trying to automate XML Data Chunking for high volume extract run. To achieve this, I have included the Extract Data Chunking task in a extract payroll flow, which is responsible for chunking the XML output generated by the extract. When Extract runs in BLOCK_OLD mode, If extract return records - the chunking task is working as expected. And when extract returns 0 records - Extract Data Chunking task is in critical alerts status. Below is the error from ESS log

javax.xml.stream.XMLStreamException: No open start element, when trying to write end element

Whenever no records, can we still run the task and get no error or Run the task 2 when only Task 1 - Extract run has records.
