Eloqua Picklist - Hard Limit in CDO Programs / Soft Limit in Contact Programs

Eloqua Picklists have a soft limit of 2500 options.
When you view or download the list, only 2500 records will be displayed. However, Eloqua allows larger list uploads, as you can see in the picture below:
I am using a picklist as part of a state validation process. Even though I was allowed to upload more than 2500 records, what I noticed during my tests today is that Eloqua applies inconsistent evaluations in CDO Programs compared to Segments / Contact programs.
The Segment local filters / shared filters are able to identify all contacts with states from the larger list of 8476 records.
However, the CDO field evaluation only works for the 2500 states at the top of the list.
