Legend in chart not sorting in the order of the report

I have a report set with the two level sorting I want to have - by month and by a text field in the report - and I have a chart using the same fields in that report.  The report grid sorts exactly as I would want it to.  The chart sorts by month correctly for the bar column lines going from low date to high date in the report, but in the legend, the values of the fields appear randomly. 

The graph is breaking down the month by the text field so each bar in the graph has multiple colors.  (see attachment) As best as I can tell. for 2 months where the first month had 3 incidents and the 2nd one had 10, the sort order of the legend appears to be going by the 3 items in the first month as the first 3 items in the legend. Then it starts back at the bottom of the bar for the next month and reads up that bar and puts the items in the legend in the order after
