Default tax code problems

We have set up our default tax code to a custom tax item (out of state)

That is when the client's ship to address zipcode is not in any of our tax item, the customer automatically will be assigned this default tax.

This is not true.

All new customers are defaulted to this tax code regardless of their zipcode.

Is there an issue about this problem?
