Web site failing 3rd part scans

It's been since April, 2010 since I first reported this most recent round of failing 3rd party vunerability scans. Case # 1144386; Issue # 179369.
I know that NS is PCI compliant, but my cc processor requires an independent scan assessment.
More than likely, the scans are throwing false positives, but I've yet to have anyone with NS support resolve this matter.
Can someone tell me why the above case and issue is hanging in limbo for four months like this?
Please advise, as our credit card processor PCI compliance verification is at stake here!!!!
