Netsuite License Fees subject to State Sales Tax ?

Anyone know if Netsuite's yearly license fee is subject to Sales Tax. We haven't been charged VA sales tax on our Netsuite License but the VA State Sales Tax Auditor has listed it as an item we didn't pay sales tax on but should have. Specifically I'm referring to Virginia but would like to know what others experience is. Thank you.
