Mandatory "cellpadding" in Category Layout?

Go to that page, then click "necklaces". I tried to make the Category Layout invisible by making it "<span></span>". The problem is, for some reason NS decided that it would be good to add "cellpadding=2" to the category layout. This causes any item layout to be pushed down by several pixels if the category has subcategories. The page jumps down and it looks quite unprofessional... I set the layout padding to "0" but it does nothing.
