NetSuite not respecting Global Subscription Preference at checkout

Wow - I think this is a pretty major problem.  Through our testing, it seems that at the moment NetSuite is not respecting the Global Subscription preference that people tick/untick during checkout.  We just had a customer go off their face....

Scary...We are lodging case as we speak.
