custom navigation - URGENT

I have created a custom navigation for our site which is pulled through via the substitution tag <customnav> now all is fine with it whilst testing as a new theme and clicking on preview all the menus work correctly.

However when making the them live when i click on menu option that has ?sc=7&category=38 (or similar) appended to the end of it it fails to load the content requested and instead loads another copy of the navigation next to it. So i get the layout and another version of the layout displayed within the area where the content should be.
